Acceptable Use Policy

1. Purpose

BookMyService is purpose-built for legitimate appointment-based service businesses. This policy defines the boundaries of acceptable use to protect merchants, their customers, and the integrity of the Platform. EverExpanse Technologies LLC reserves the right to determine, in its sole discretion, whether use of the Platform is consistent with this policy.

2. Permitted Use

The Platform is designed for and limited to legitimate, consumer-facing, appointment-based service businesses operating within the United States. Examples of permitted business types include — but are not limited to:

• Hair salons, barber shops, nail salons, and beauty studios
• Day spas, blow dry bars, waxing studios, and makeup studios
• Massage therapy, skin care studios, and facial studios
• Med spas (non-clinical, non-HIPAA scheduling only)
• Wellness centers, health coaching, nutrition coaching, and life coaching
• IV hydration lounges, aromatherapy, and reflexology services
• Pet grooming, dog training, pet daycare, and pet sitting
• Personal trainers, fitness coaches, and strength coaches
• Yoga studios, Pilates studios, dance studios, and martial arts schools
• House cleaning, maid services, and home organization
• Carpet cleaning, window cleaning, and vacation rental cleaning
• Photography studios and portrait sessions
• Tutoring, music lessons, and educational coaching

3. Prohibited Business Types

The following business types are expressly prohibited from using the BookMyService platform:

Healthcare & Clinical Services

• Any business that constitutes a "covered entity" or "business associate" under HIPAA
• Businesses handling protected health information (PHI), patient records, diagnoses, or treatment plans
• Clinical medical practices, hospitals, urgent care centers, or licensed clinical services
• Mental health therapy practices billing insurance or maintaining clinical records (non-coaching wellness coaching is permitted)
• Chiropractic and physical therapy practices that maintain clinical patient records

Adult & Entertainment

• Adult entertainment, strip clubs, escort services, or any sexually explicit businesses
• Massage businesses operating outside of licensed therapeutic or wellness contexts

Regulated & Restricted Industries

• Gambling, lottery, sports betting, or any games of chance
• Cannabis dispensaries, hemp product retailers, or any business operating contrary to federal law
• Firearms dealers, gunsmiths, or businesses selling ammunition or explosives
• Tobacco, e-cigarettes, or vaping product retailers
• Alcohol retailers or distributors (bars or restaurants are not appointment-based and are excluded)
• Money transmission services, check cashing, or unlicensed financial services
• Insurance brokers, securities dealers, or financial advisors requiring regulatory licensing
• Businesses on the OFAC sanctions list or operating in sanctioned jurisdictions

Fraudulent & High-Risk

• Pyramid schemes, Ponzi schemes, or multi-level marketing recruitment businesses
• Telemarketing, robocall services, or TCPA non-compliant outreach businesses
• Businesses with a history of excessive chargebacks or payment fraud
• Businesses misrepresenting their nature, ownership, or operations

4. Prohibited Activities

Regardless of business type, the following activities are prohibited on the Platform:

• Collecting, storing, or transmitting payment cardholder data (card numbers, CVV, expiration dates) outside of the approved payment gateway environment
• Storing protected health information (PHI) or clinical patient data of any kind
• Impersonating another business, merchant, or EverExpanse employee
• Using the Platform to send spam, unsolicited marketing, or bulk communications without appropriate consent
• Attempting to gain unauthorized access to other merchants' accounts or customer data
• Reverse engineering, decompiling, or extracting source code from the Platform
• Using automated bots, scrapers, or crawlers to extract data from the Platform
• Uploading or transmitting malware, viruses, or any malicious code
• Circumventing any rate limits, access controls, or security features of the Platform
• Sharing account credentials with unauthorized third parties
• Using the Platform to facilitate transactions for prohibited businesses described above
• Creating fake bookings, inflating customer records, or manipulating Platform analytics

5. Content Standards

All content you publish on your BookMyService storefront, staff profiles, and service listings must:

• Accurately describe your business, services, and pricing
• Comply with applicable FTC advertising guidelines and state consumer protection laws
• Not contain false, misleading, or deceptive claims
• Not infringe on any third party's trademark, copyright, or intellectual property rights
• Not contain hate speech, discriminatory language, or content targeting individuals based on protected characteristics
• Include clear, lawful cancellation and refund policies that are honored in practice

We reserve the right to remove any content that violates these standards without prior notice.

6. Legal Compliance

You are responsible for ensuring your use of the Platform complies with all applicable laws, including:

• Federal and state consumer protection laws
• State licensing requirements for your industry (cosmetology, massage therapy, personal training, etc.)
• FTC regulations regarding advertising, endorsements, and consumer data
• CAN-SPAM and TCPA requirements for any customer communications you send through the Platform
• Applicable card network rules (Visa, Mastercard, Discover, American Express) when accepting card payments
• All applicable tax laws for your business type and location

7. Geographic Restrictions

BookMyService is available exclusively to businesses operating within the United States. The Platform may not be used from or on behalf of businesses located in:

• Countries subject to U.S. economic sanctions (OFAC-designated territories)
• Jurisdictions where our payment gateway partners do not currently provide service

Payment processing availability may vary by state depending on gateway partner licensing and compliance requirements. EverExpanse makes no representation that the Platform is available or appropriate for use in all U.S. states.

8. Enforcement

We monitor for compliance with this policy and reserve the right to take any of the following actions for violations:

• Issue a warning and request corrective action
• Temporarily suspend your account pending investigation
• Permanently terminate your account without refund
• Report illegal activities to appropriate law enforcement or regulatory authorities
• Pursue legal remedies for damages caused by violations

For egregious violations — including fraud, illegal activity, or material misrepresentation of business type — we may take immediate action without prior warning.

9. Reporting Violations

If you believe another merchant is violating this policy, or if you have identified a security vulnerability in the Platform, please report it to us at info@bookmyservice.us. We take all reports seriously and will investigate promptly.
